Our professional fee is US$200 per class when we file, then US$100 plus US$100 per class when the mark registers. The registration stage falls due only if the application is accepted, roughly 8 to 12 months later. Japanese official fees are quoted in yen because that is what the JPO charges; the dollar figures on this page convert at JPY 150 to the dollar and are indicative. Office action work is charged at the rates above; we tell you which applies before doing anything, and you decide whether to proceed. Where you claim retail services for goods in unrelated fields, the JPO presumes you cannot be using all of them and asks for evidence of use or a business plan. Narrowing to one field avoids it entirely; the selector warns you before you get there.

Questions people actually ask

Why choose the goods and services myself?

Because that choice is where trademark fees hide. Most firms bill for the drafting, and the drafting is where they can be generous with your money. The JPO publishes a standard list of 16,545 accepted terms; if you pick from it, no drafting is needed and no examiner argues about wording. You know your business better than we do. What you are paying us for is everything after that.

What if I pick the wrong classes?

Tell us in the notes field and we will look before filing. If something is clearly off — a restaurant filed in class 30 instead of 43 — we will say so and reissue the quote before you pay. What we will not do under this service is design the specification for you. If you want that, ask us for a quote instead of ordering here.

Do I need to be in Japan, or have a business there?

No. Japan does not require use or a local presence to file. It does require a resident representative, and we act as that representative. You do need a genuine intention to use the mark for what you claim — that is what the declaration above is about.

Why does the selector warn me at 22 classes of codes?

Under Article 3(1) of the Japanese Trademark Act, if you claim an unusually broad range within one class, the examiner presumes you cannot be using all of it and issues a query. Answering it costs time and money. The warning appears before you get there, so you can trim.

How long does it take?

We file within two business days of payment clearing. The JPO then examines, which currently takes roughly 8 to 12 months to a first result. Registration follows about a month after you pay the registration fee. There is a fast-track route in some circumstances — ask.

What happens if the application is refused?

You get a provisional refusal with reasons, and normally three months to respond, extendable. We translate it and tell you what we think your chances are. Where the answer is simply to delete some of the goods, the amendment is US$200. Where it needs a reasoned argument — a cited earlier mark, for instance — it is US$400. You can also stop there, or instruct someone else.
